Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Cazador Digital LLC, a Wyoming limited liability company (“we”, “us”, “our”). They govern your use of the Ailelo mobile app (the “App”), the website at ailanguagelearningapp.com (the “Website”) and related services (together, the “Services”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy at https://ailanguagelearningapp.com/privacy. If you do not agree, do not use the Services.

1. Who can use Ailelo

You must be at least 16 years old to use the Services. If you are using them on behalf of an organization, you confirm you have authority to bind it. You must provide a working email address and keep your sign-in secure. You are responsible for activity on your account.

2. What Ailelo does

Ailelo is a language-learning app. You can upload study materials you own, such as textbooks, and the App uses artificial intelligence to extract vocabulary and grammar and to generate lessons, audio, readings, flashcards, writing practice and tutor conversations from them.

Features, limits and allowances can change over time. Monthly allowances (for example lessons, readings, chat turns and writing practice) reset each billing period and are not unlimited. The App shows how much of your allowance you have used and when it resets.

3. AI output and no guarantees of results

Much of the App’s content is generated by AI. It can be wrong, incomplete, out of date or inappropriate, including translations, explanations, grammar notes, readings, grades and feedback. Check important information against reliable sources, such as your textbook or a qualified teacher. The App gives general feedback on your language use. It is not a pronunciation or accent assessment and not a replacement for a teacher. We do not promise that you will reach any level of fluency or pass any exam.

Do not rely on the Services for medical, legal, financial, safety-critical or other professional advice.

4. Your materials and your content

Ownership. You keep your rights in the materials you upload and in the content you create (“Your Content”). We do not claim ownership of them.

License to us. You give us a limited, non-exclusive, worldwide license to host, copy, process, transform and display Your Content, and to send it to our service providers, only as needed to operate the Services for you, as described in the Privacy Policy. We do not use Your Content to train our own AI models.

Your promises. When you upload anything, you confirm that you own a purchased copy of it or hold a valid license to its content, and that you are uploading it solely for your own personal language study. You must not upload material you have no right to use, and you must not share, resell or publish the generated content in a way that infringes anyone’s rights. You are responsible for Your Content and for having the rights you claim.

Copyright complaints. If you believe content in the Services infringes your copyright, email [email protected] with enough detail to identify the work and the content. We may remove content and suspend accounts that infringe the rights of others.

5. Acceptable use

You agree not to:

• break the law or infringe anyone’s rights;
• upload malware, or material that is unlawful, abusive or sexually exploitative of minors;
• try to access another person’s account or data, or probe, scan or test the Services for weaknesses without our written permission;
• interfere with or overload the Services, or bypass usage limits or security;
• scrape, copy, reverse engineer or extract the Services or their output at scale, or use them to build a competing product or to train an AI model;
• share your account, or resell or offer access to the Services to others;
• use the Services to generate content that is harmful, hateful, deceptive or that misrepresents AI output as human work where that matters;
• upload highly sensitive personal information about yourself or others, such as government ID numbers, health records or financial account details.

6. Subscriptions, trials and payments

Plans. Some features require a paid subscription. The price, billing period and any free trial are shown in the App and in Google Play before you subscribe. The price may vary by country and taxes may apply.

Billing through Google Play. Purchases are made and charged through Google Play, and Google’s terms apply to your purchase. We do not receive your payment card details. We use RevenueCat to confirm your subscription status.

Free trial. If we offer a free trial, it begins when you start it in Google Play. Unless you cancel before it ends, your subscription renews automatically at the listed price. A free trial is offered once per account, and we may refuse a trial where we suspect abuse.

Renewal and cancellation. Subscriptions renew automatically each period until you cancel. Cancel any time in Google Play under Subscriptions. You keep access until the end of the period you have paid for. Deleting your Ailelo account does not cancel your Google Play subscription. Cancel first to avoid further charges.

Refunds. Refunds are handled by Google Play under its refund policy. Contact Google Play for a refund request. Where the law gives you a right to a refund, it is not affected by these Terms.

Price changes. If we change the price of a subscription, we will give notice as Google Play requires, and the change will apply from your next renewal after you have had the chance to accept or cancel.

Complimentary access. We may give some accounts free or discounted access. We can end it at any time unless we have agreed otherwise in writing.

7. Account deletion and termination

You can delete your account at any time in the App, under Account, then Delete account. What happens to your data is described in the Privacy Policy.

We may suspend or end your access if you breach these Terms, if we must do so by law, if your use creates risk or cost for us or others, or if we stop offering the Services. Where reasonable, we will tell you why. If we end a paid subscription without cause, we will refund the unused part of the period you paid for.

8. Our rights

The Services, including the App, its design, software and content we create, belong to us or our licensors and are protected by law. We give you a personal, limited, revocable, non-transferable license to use the App for your own personal learning, subject to these Terms. We reserve all other rights.

If you send us feedback or ideas, we may use them without obligation to you.

9. Third-party services

The Services rely on third parties, including Google (Gemini, Cloud Text-to-Speech and Google Play), Clerk, Cloudflare, RevenueCat and Expo. They have their own terms and we are not responsible for their services. The Services may be interrupted if a third party has an outage.

10. Availability and changes

We work to keep the Services running, but we do not promise they will be uninterrupted, error-free or always available. We may change, suspend or discontinue features at any time, and we may update these Terms. For a material change, we will notify you in the App or by email before it takes effect where reasonable. If you keep using the Services after the change, you accept the updated Terms. If you do not agree, stop using them and delete your account.

11. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI OUTPUT IS CORRECT OR THAT THE SERVICES WILL MEET YOUR NEEDS.

Some places do not allow certain disclaimers, so some of this may not apply to you.

12. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM AND (B) US$50.

Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence, or your rights as a consumer under mandatory local law.

13. Indemnity

You agree to defend and compensate us for losses and costs arising from claims caused by Your Content, your breach of these Terms, or your infringement of another person’s rights, to the extent the law allows. This does not apply where it would be unlawful or where you are a consumer protected by mandatory law.

14. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live. Before starting a formal claim, please email us and give us 30 days to try to resolve the issue. Subject to mandatory consumer law, any dispute not resolved informally will be brought in the state or federal courts located in Wyoming, and you and we consent to their jurisdiction.

15. General

These Terms and the Privacy Policy are the entire agreement between you and us about the Services. If a part is found unenforceable, the rest stays in effect. Our not enforcing a right is not a waiver of it. You may not transfer your rights under these Terms. We may transfer ours, for example in a merger or sale of the business. Headings are for convenience only.
